In short

1. Who we are and what these terms cover

Lumifine Media And Tech Solutions ("Lumifine", "we", "us") is a sole proprietorship run by Arkadeep Chakraborty in Kolkata, West Bengal, India. We provide media services (photography, film, editing, design, marketing, PR and influencer campaigns) and technology services (websites, apps, technical management and security).

These terms apply to every quote, project and monthly service we provide, and to your use of this website. The Payment Terms, Cancellation & Refund Policy, Delivery Policy, Security Testing Terms and Privacy Policy are part of these terms. "You" means the person or business we work for.

2. How a project starts

  1. You tell us what you need, through the enquiry form, WhatsApp or the free 15-minute call.
  2. We send a quote that sets out the scope: what we'll deliver, the price and, where it matters, the timeline.
  3. You accept the quote in writing. A message on WhatsApp or email is enough.
  4. You pay the first part. Work starts once it has reached us and we have the materials we need from you.

If the quote and these terms disagree, the quote wins for that project. If the website and a quote disagree, the quote wins. Prices on the website can change, but a quote you've accepted doesn't.

3. Prices and payment

Prices are in Indian rupees, or US dollars for clients outside India, and are fixed for the scope in the quote. Lumifine isn't registered under GST, so no GST is added. Payment is in two parts: 50% to start and 50% on delivery. Monthly services are paid at the start of each month. The full rules, including the first-project offer, are in the Payment Terms.

4. What we need from you

5. Scope, changes and revisions

Each project includes two rounds of changes within the agreed scope. A round is one consolidated set of feedback that we then act on together. Changes that alter the brief, add deliverables or start a new direction are new work, and we'll quote them before doing them. Extra rounds beyond the two included are also quoted before we start them.

6. Timelines and delivery

Timelines are agreed for each project in writing before work starts. We deliver digitally, and what that involves is set out in the Delivery Policy. Final files and handover follow payment of the second part.

7. Third-party costs and platforms

Unless the quote says they're included, you pay for anything provided by someone other than us. That includes ad spend, creator and influencer fees, stock media and music licences, fonts, printing, travel outside Kolkata, drone and location permits, domains, hosting, software subscriptions and app store accounts. We'll tell you about these costs before you commit to them.

Platforms such as Instagram, YouTube, Google, Meta, app stores and hosting providers have their own rules and can change them, restrict accounts or go down. We work within their rules, but we don't control them and aren't responsible for their decisions or outages.

8. Who owns the work

Your final work. When you've paid in full, we hereby assign to you all our rights in the final deliverables we create for you under the quote. That includes the final photos, videos, designs, copy, website and app code, and the raw and source files, which are included at no extra cost. We won't object to you editing, adapting or reusing the final work for your business.

What stays ours. We keep the tools, templates, code libraries, presets and know-how we had before your project or build for our general use. Where any of them are part of your deliverables, you get a permanent, royalty-free right to use them as part of that work.

Other people's material. Stock media, fonts, music, plug-ins and open-source software stay under their own licences. We'll tell you what's used and pass on any licence terms that apply to you.

Our use of the work. We may show the work in our portfolio, on our website and social media, and in our own ads, promotional videos and advertisements. If you'd rather we didn't, tell us in writing before or at delivery and we won't. We never show security work, or anything you've told us is confidential.

Before full payment, the work stays ours, and previews are shared only so you can review them.

9. Use of AI tools

We may use AI tools to help with parts of the work, such as voiceovers, drafts, image clean-up or code. A person directs the work and checks everything before it reaches you. Ask us and we'll tell you which tools were used on your project. The law on who owns AI-generated material is still developing, and parts produced mainly by AI may have limited copyright protection.

12. Security work

Penetration testing, vulnerability assessments, scans, phishing drills and similar work only happen with written authorisation and within an agreed scope. The Security Testing Terms apply to all of it.

13. Confidentiality

We keep your non-public information confidential: business plans, customer data, access details, unreleased products and anything you mark as confidential. We use it only for your project and share it only with people who need it to do the work, under the same duty. This doesn't apply to information that is already public, or that the law or a court requires us to disclose.

How we handle personal data is explained in our Privacy Policy.

15. Work we won't do

We may refuse or stop work that is illegal, or that infringes someone else's rights. That includes work that is defamatory, obscene, hateful or misleading, that involves accessing systems without authorisation, or that sends spam. If we stop a project for this reason, the Cancellation & Refund Policy applies as if you had cancelled.

16. What we promise, and what we don't

We'll do the work with reasonable skill and care, and deliver what the quote describes. Apart from that, and to the extent the law allows, we make no other promises. We make none about business results, about uninterrupted third-party services, or that a security test finds every vulnerability.

17. Limits on our liability

18. Your responsibility for what you give us

If someone makes a claim against us because of material or instructions you provided, you'll cover our reasonable losses and costs. Examples are a photo you didn't have the right to use, a false claim you asked us to publish, or a system you told us you were authorised to have tested when you weren't.

19. Cancelling and ending work

You can cancel as set out in the Cancellation & Refund Policy. We may pause or end work if a payment is unpaid, if you ask for work covered by section 15, or if you or your team treat us abusively. Sections 8, 13, 16, 17, 18 and 22 continue after a project ends.

20. Events beyond anyone's control

Neither of us is responsible for delays caused by events outside reasonable control. Examples are natural disasters, severe weather on a shoot day, strikes, illness, government orders, or internet and platform outages. We'll keep each other informed and agree new dates.

21. Using this website

We keep the information on this site accurate and current, but prices and services can change until you accept a quote. You may not copy or reuse the site's design, text or code without our permission. Links to other sites are for convenience, and we aren't responsible for their content.

22. Changes to these terms

We may update these terms. The date at the top shows the latest version. A project is governed by the terms in force when you accepted its quote.

23. Law and disputes

These terms are governed by the laws of India. If a disagreement comes up, we'll first try to settle it by talking, for at least 30 days. If that doesn't work, the courts in Kolkata, West Bengal have jurisdiction.
